Legal Requirements

Machinery Directive 2009/104/EC – Minister of Economy Regulation of October 30, 2002 on the minimum safety and occupational health requirements for the use of machinery by employees at work.

§ 1 Whenever the regulation refers to a "machine," it means all machines and other technical devices, tools, and installations used at work, as well as equipment for temporary work at height, in particular ladders and scaffolding (...).
§ 27 The employer should ensure that machines exposed to conditions causing deterioration of their technical condition, which may give rise to dangerous situations, are subject to periodic inspections and tests by units operating under separate regulations or persons authorized by the employer with appropriate qualifications (...).
§ 28.1 Results of inspections referred to in §§ 26 and 27 shall be recorded and stored, available to the relevant authorities, especially labor supervision, for five years from the date of the last inspection unless separate regulations provide otherwise.

§ 40.1 The employer is obliged to ensure systematic control of safety and health at work conditions, paying particular attention to the organization of work processes, technical condition of machines and other technical devices, and establish ways of recording irregularities and methods for their removal.
§ 51.1 Machines and other technical equipment, hereinafter referred to as "machines," must meet occupational safety and health requirements specified in separate provisions for their entire period of use.
§ 51.2 Assembly, disassembly, and operation of machines, including their use, must be carried out in compliance with safety, health, and ergonomic requirements, taking into account the instructions contained in the technical and operating documentation.
§ 57 Machines, tools, and their protective devices shall be maintained in technical condition and cleanliness ensuring their safe use and shall only be used for processes and conditions for which they are intended.
